Hajj Law Without Tashrih (Official Hajj Permit or Visa)

Hajj is one of the biggest forms of slavery in Islam. This is the fifth pillar of Islam, and is only needed for a lifetime for those who are able to buy it. Hajj contains many meanings and lessons: subject to God, patience, struggle, brotherhood, and equality before him.

Allah Ta’ala said,

And to God for the pilgrimage of the house, anyone who can go to the path ۚ and anyone who does not believe, then God is rich in the world

“Doing Hajj is a human obligation to God, namely for those who are able to travel to Baitullah. Anyone who does not obey (pilgrimage), of course God is rich (does not need something) from all over the world. ” [1]

Hajj is a worship that has a very large virtue. In the hadith mentioned,

Umrah to Umrah as a redemption for what is between them, and the true pilgrimage does not have a prize except heaven

“Umrah to the next Umrah becomes an eraser of sin between the two. And the pilgrimage mabrur, There is no reply except heaven. ” [2]

Every year, millions of Muslims from various parts of the world are flocking to the Holy Land to perform the pilgrimage. However, behind this spirit, there are also various challenges and violations that demand attention, such as Hajj without official permission, which can actually damage the goals of the syar’i from this worship.

At present, the government of the Kingdom of Saudi Arabia as the main organizer of the pilgrimage has required every prospective congregation to get Dashrih Official, namely the Hajj Permit. This is not just an administrative rules, but a step to maintain the security, comfort, and safety of millions of worshipers from various parts of the world. This system is implemented because of the large number of pilgrims registrants, while the capacity of Mecca, Mina, Arafat, and Muzdalifah is very limited.

But in reality, there are still many Muslims who perform the pilgrimage without Dashrih (Official Permit or Visa). A phenomenon that is alarming and needs serious attention. They violated the rules set by the Saudi Arabian government, for the sake of a strong desire for Hajj even though it was not in accordance with procedures. In fact, the implementation of Hajj without official permission can endanger personal safety, disturbing order, and damage the image of Islam as a religion that upholds obedience and order.

How the law to make a pilgrimage without Dashrih?

Although this rule has been wide and clear, some people still try to perform the pilgrimage without Dashrih. They infiltrate through illegal paths or use fake identities. This raises various questions: What is the status of their pilgrimage in a Shari’a? Is it legal? Is it sinful?

The scholars distinguish between the validity of worship and sinful due to violations of the rules. If someone is happy emit But still carrying out all the harmony and conditions of the pilgrimage, so the hajj is valid, but he sinned because he had violated the legal rules (government). That is, the entire series of pilgrims that he does is legitimate; But at the same time, he also sinned.

Proposition is the word of God,

O, you who believe, obey God and obey the messenger and the first of your problem

Allah Ta’ala said (which means), ‘Then afraid of Allah as much as you can’ [4]; And Allah also says (which means), ‘And (obligation) of humans towards God is to carry out the pilgrimage to Baitullah, namely for those who are able to take it.’” [5] [6]

“Hajj is valid, but accompanied by sin, because it violates the rules set by Waliyul Amr (Ruler) for the sake of community and pilgrims. Then, obey Waliyul Amr This is mandatory, because it wants the good of the community and regulates the implementation of pilgrimage. So the Hajj is valid, but he sinned and committed a crime in his pilgrimage. One cannot sin to fulfill the practice of sunna. Hajj (second and so on) is sunna, if done once. And crime for Waliyul Amr illegal. Therefore, it is not possible to do illegal things to practice sunnah. ” [8]

Why it must be there Dashrih?

Some of the reasons for shar’i and logical why Dashrih required,

1) Regulate the number of pilgrims so as not to exceed the capacity of the holy place.

2) Maintaining the safety of the congregation from traffic jams, fatigue, and push.

3) Ensuring decent services such as water, food, and transportation.

4) Facilitate supervision and health, especially when there is a pandemic.

5) Increase the effectiveness of pilgrims management.

Islamic sharia comes to maintain five things: religion, soul, intelligence, wealth, and descent. So, the rules Dashrih is part of guarding the soul and safety of the people. All of this is a form Good (well -deing) guarded by sharia.

Obey the procedure, Hajj mabrur, Willing God

Islam is a religion that teaches compliance and discipline. Included in pilgrimage, we are encouraged to do it in the right way and not violate the law.

Rasulullah Shoullahu ‘alaihi wasallam say,

He who obeyed me had obeyed God, and anyone who did not obey me, may God not obey, and anyone who obeys the prince has obeyed me, and anyone who does not obey the prince has not obeyed me

“Anyone who obeys me, then he really has obeyed God. And anyone who has devoted me, then he has been ungodly to God. And anyone who obeys the leader, then he has obeyed me.” [10]

Performing the pilgrimage is the ideals of every Muslim. However, to achieve the perfect reward, we must do it in the right way and not violate the rules. Hajj without Dashrih It is valid, but it can lead to sin because it excludes the command Waliyul Amr and hurt others.
