Afwan ustadz permission to ask, from the MBG, for example, if there is something that the students don’t take (perhaps because it is distributed during holidays, etc.) then it is distributed to teachers/school employees/other members of the community, what is the status? is it allowed?
ANSWER
Wa’alaikumussalam warahmatullahi wabarakatuh
MBG is a central government policy, including all kinds of funding efficiency by reducing other funding items. That’s state policy, even if we don’t agree, as long as it’s not a matter of immorality and when the hammer is knocked, it must be implemented by officials, both schools and government agencies.
So can teachers accept MBG?
This program is a special form of social assistance for students. So in fact it is the student’s right, not the teacher’s or other party’s right.
If the teacher also eats the student’s share:
– The law is not permitted except with official permission from the organizer (school/department).
– Because it falls into the category of akl maal ghayr bi ghayr haqqih (consuming other people’s property without rights).
– The Prophet ﷺ said:
“It is not lawful for a Muslim to have wealth unless he is willing to do so.”
(HR. Aḥmad, al-Baihaqi, and others)
If there is leftover food that is allowed to be shared (for example, students don’t finish it, then the school allows it to be distributed to teachers/staff), the students are also happy and don’t mind, then it is halal, because it has become legal tasharruf.
Like a gift from a student who is happy with it.
If the teacher takes it without permission or for the reason “instead of it being wasteful”, the law is still not permitted, unless there is a clear tasharruf from the owner of the right (student/school). Because waste cannot be used as an excuse to take away other people’s rights.
