QUESTION:

Assalamualaikum ustadz permission to ask. Father & mother (deceased) had 8 children. 4 women 4 men. Child number 3 (female) died (not married). Then child number 1 (female) died leaving her husband and 2 female children. How is the inheritance distributed to the children? Please enlighten us, sir

Mother died in 2000, then father in 2020. Child number 3 (female) died in 2022, then child number 1 (female) died in 2024. When mother died, none of her assets were inherited.

ANSWER

Toyib… Then there are 3 stages of division

First. When a father dies, the only people who can inherit are all his children. His mother didn’t, because she died before his father.

The boys section is 2x the girls section

Second. The share of the 3rd child who dies in 2022 will be inherited back to his existing siblings. In the Shafi’i sect, a brother can have 2 sisters.

Third, the share of child 1 (who dies in 2024), is inherited to:

– Her husband gets 1/4
– 2 daughters get 2/3 (divided equally)
– The remainder goes to all his siblings, the male portion is 2x the surviving female sibling
